Abstract: 國內工程爭議探討雖已行之有年,但工程爭議探討之議題均以公共工程爭議為主,反觀國內民間私人發包之營建工程,有關起造人與營造廠雙方之工程爭議糾紛時有所聞,但實際發展之樣態卻不得而知。因此本研究以新竹縣市民間自建營建工程之民眾與承攬此類型工程之營造廠為研究對象,調查自建民宅於履約過程中爭議發生比例多寡及容易衍生之爭議類型。希望藉此了解民間工程爭議發展現況及其與公共工程爭議發展之差異。 本研究以2004年公共工程委員會之採購申訴審議委員會調解之工程爭議類型作為問卷分類架構,共計發出問卷一百二十份。經問卷分析結果得知,新竹新竹縣市民間自建營建工程爭議發生率為37.5%,其工程爭議發生率最高者為「工程品質之爭議」與「工程驗收之爭議」,解決爭議之方式以和解為主。而「工程品質合格與否的判定基準不明」與「驗收扣款之問題」是民間自建營建工程之工程爭議最顯著的爭議因素。且爭議發展類型亦與公共工程發展類型顯著不同。
The construction complaint had been discussed so many years but it majority focus on public construction. There is some complaint news exposing between client and contractor in private building construction. But the actual circumstance is unknown. So, this study focuses on contractor in private building construction in Hsin-Chu County to study the complaint ratio in different subcontract type. This will help us to understand the complaint differentiation between private and public construction. This study use construction complaint type to be questionnaire category framework that is in Complaint Review Board for Government Procurement of Public Construction Commission in 2004. The total issued questionnaire is 120. The complaint ratio is 37.5% in Hsin-Chu private building construction by this study analysis and the highest complaint ratio is on construction Quality and Acceptance. In most of cases to solve complaint is reconciliation. On the other hand, the unclear criteria in construction quality judgment and the block issue in construction payment are the most effective complaint factors in private construction. And, the construction complaint type is obvious different with public construction.
