提昇行車事故鑑定品質及建立交通事故鑑定師制度之研究

Abstract

交通事故鑑定工作乃釐清事故責任之依據，重建事故發生過程之公正客觀與專業要求相當重要。國內現行鑑定作業受限於人力、證據蒐集與制度之限制，其鑑定結果常受到當事人之質疑，徒失專業鑑定之功能。 本研究擬根據鑑定品質、財務自給、與專業經營之角度，設計不同法律位階與運作機制之可行鑑定制度。分析其專業認證、教育訓練、專業良知、財務與交通安全回饋等機制。並提出政府於各種制度內所參與之角色定位，透過問卷設計訪談，收集並分析評選最佳制度方案。 本研究之工作目標，以「提升行車事故鑑定品質」為前提，比較各鑑定制度之優劣，建議可行之鑑定制度及相關配套措施及其施行期程，構建完善且有效率之鑑定制度施行內容與計畫以供主管當局參考。

Traffic accident adjudication and reconstruction play important roles in post-accident management. They provide the professional evidence for the process of legal disputes and help to declare the liability of the accident. An ideal system for Accident Adjudication Licensing might achieve five goals as the following: developing and monitoring quality of the accident adjudication; providing profession ethics; developing quality of evidence acquired at the first scene; maintaining justice for the whole society; and avoiding wasting the social resource. This study will compare the various adjudication operation systems in terms of financial, technical aspects. Based on the objective of ?§Improving the quality of the traffic accident adjudication ??, this study will focus on designing and determining an ideal system that could fit the objective best.
