摘要: | 專利布局隨著科技發展之演進,已成為企業智慧財產管理上不可或缺之一環,其重要性甚至可能影響一間公司之成敗。本論文主要欲建構一專利布局之分析模式,將專利與產業、市場及法律議題結合,深度探討專利布局的實質意義與價值,引導企業跳脫固有的專利指標、技術功效矩陣之傳統專利布局模式之思維。本研究觀察到多數企業,多以專利檢索工具,專利指標分析作為專利布局的評判標準,但這樣的專利布局有其侷限性。除此之外,企業多以專利的量作為其績效評估指標,以至於申請大量專利卻不得其法,真正有價值的專利不易產出。本研究賦予專利布局較廣義的定義,將其分成戰略階段、技術階段及商業階段。戰略階段包含策略與定性,必須將專利布局與產業特性相結合;技術階段則包含檢索、研究及申請,此係過往專利布局的核心;商業階段以專利授權、專利訴訟及專利聯盟為其主要內涵。希冀透過三階段的垂直整合,能建構一套適於企業之專利布局方法論。最後本文提供一套專利布局績效評估指標,並以工業技術研究院近年相當成功之AC LED專利布局案例為例,佐證上述論點。希望研究中所提的方法與結果,能對於企業中之專利布局決策者有所助益。 With the evolution of science and technology, patent deployment has become an integral ring in the intellectual property management for enterprises. Its significance may even affect the success of a company. In order to find out the value of patent deployment and to guide enterprises to escape the traditional patent deployment method (such as inherent patent indicators and technology function matrix), this thesis constructs an analytical model of patent deployment, which combines patent with industry, market and legal issues. The majority of domestic enterprises use patent searching tools and patent indicators as criteria of patent deployment, but this kind of patent deployment has its limitations. In addition, many companies use the amount of patents as a key performance index, resulting in a large number of useless patent applications. This study gives a broader definition of patent deployment, dividing it into three stages - the strategic, technical, and commercial stages. The strategic stage involves tactics and characterization, and combines patent deployment with industry characteristics. The technical stage used to be the core of patent deployment, containing retrieval, research, and application. The commercial stage has patent licensing, patent litigation, and patent alliance as its main contents. Through the vertical integration of the three stages, a suitable patent deployment methodology can be constructed. Finally, this paper provides a set of patent deployment key performance indexes and applies it to the ITRI AC LED patent deployment strategy, which is a considerable success in recent years and also an example to support the above argument. This study’s methods and results mentioned may be useful to enterprise patent deployment decision-makers. |
