Abstract: 由於跨國流動、性別平權、性向開放等客觀社會事實之存在,人民生活及家庭組成的多元化已是不爭的事實,再者,觀察當今臺灣社會,我們亦發現親密關係的結合與實踐形式亦非常多元,但是法律卻只對傳統觀念的「一夫一妻制的婚姻關係」做相應規定,根本無法保障諸多其他生活型態之多元家庭。根據伴侶盟的網站數據,台灣現今符合傳統核心家庭圖像的家庭根本不到50%,但是以目前台灣的法律制度,對於那些未踏入「傳統一夫一妻制婚姻關係」的多元家庭,卻是排除在法律之外。是以,面對日益增多的多元家庭及由此產生的一系列法律問題,我國法律究竟有無必要尊重多元家庭的事實在先性,合理規範多元家庭當事人之間的權利義務,保護其合法利益,應是刻不容緩需要被討論及確認的問題,故本文將以此為開展,以確立伴侶制度設置之必要性為首要研究目的。
惟任何制度的形成,必然會有反對與贊成的聲音,而制度的使用者是廣大的社會大眾,故實在有必要傾聽贊成跟反對者的聲音,以做而伴侶制度未來立法之基礎,故本文分別以七位具有同居經驗之受訪者之質性訪談結果及491份有效問卷之量化分析,並從各國已施行的不同模式中,尋找適合我國目前社會狀態之模式,以提出符合我國國情之本土化之具體可行建議。
Due to the objective social status of the cross-border flow, equal gender rights, openness of sexual orientation, etc., the diversified lifestyle and families are indisputable facts. On the other hands, in observing contemporary society in Taiwan, we also realize that while in practice the combinations and forms of intimate relationships are already very diverse, but our current laws and regulations only address the traditional concept of oppsite-sex marriage instead providing protection to many other types and needs of diversified families. According to statistics of The Taiwan Alliance to Promote Civil Partnership Rights, less than 50% of the families in Taiwan today conform to the traditional image of the nuclear family, but our laws and regulations, though, exclude such other diversified families and disregard their rights.
In facing more and more diversified familes and corresponding legal issues, it is necessary and urgent to discuss and confirm the need of regulations for such diversified families, therefore, this article is intented to, based on the above facts, confirm the need to fashion a new legal regime regarding civil partnerships as the first research purpose.
Furthermore, any new legal system are assumed to arouse different voices and opinions, so in order to collect and compromise all voices, this article through analyses of 7 interviewees having experienced cohabitation and 491 questionairies, hopes to provide the practicable and suitable suggestion for partnership in Taiwan.
