美國聯邦巡迴上訴法院之專利適格性判斷實證研究—美國最高法院Mayo v. Prometheus案之影響

Abstract

本文檢視美國聯邦巡迴法院的諸多判決，以了解美國最高法院近來之判例法於專利適格性的影響，本文解析該些判決並利用質性與量化研究分析解析的結果。再者，藉由分析系爭專利範圍的特徵，本文提供專利實務者對於專利適格檢測重要的專利範圍特徵。

This article reviews the decisions of Court of Appeals for the Federal Circuit to understand the impact of the U.S. Supreme Court’s recent case law on the patentability issue. This article decodes those decisions and analyzes the results by quantitative research and qualitative research. In addition, by analyzing the characteristics of the claims at issue, this article provides practical suggestions for patent practitioners regarding the characteristics of claims that are relevant to the eligibility test.
