採用快捷式工程及單價承攬契約之問題研討

Abstract

摘要

台灣被稱為科技矽島。近年來高科技廠房之興建，在營建工程中佔有相當之比重。追求更快之建廠速度，是台灣業主所追求之目標，如何縮短建廠時間，一直是高科技產品業界努力的方向。縮短工程建設時間，除了在工程技術的研發與提升外，亦可從規劃、設計到發包之前置作業來作改善。總價承包為一般所習慣採用之發包模式。 本研究將探討在高科技產業工程中，於國內業界常用之發包模式，以私人工程為主體，輔以政府公共工程之相關規定，就工程之不同特性，在成本、進度、工程執行界面、工程契約爭議事項、保險等相關議題，以業主、建築師或工程管理顧問公司、廠商之角度，並依參考文獻、政府法令相關規定、以實際案例來作檢討，期望於工程之契約型態中，可尋求較適切之建議方式。

Abstract Taiwan is called the Technical Si Island. In recent years, construction of the high tech workshop has the certain percent of all construction in Taiwan. To seek the higher speed of workshop building time, it is the owners’ goal in Taiwan. How to reduce the time? This problem is the direction of high tech industry to go ahead. To reduce the time of workshop building, it not only researches and improves the skills of construction, but also reforms the previous phases just like planning and designing. Lump-sum contract always uses to be the mode of contract out. This research will discuss in the high tech industry projects that commonly used sends a package of pattern to the domestic field. Take the personal project as the main body. Auxiliary correlation of stipulation combines with government public works, on project different characteristics, like cost, progress, construction execution side, project contract dispute item, insurance and so on related subjects. By the owner, the architect or the project management consultant firm, the merchant angle of, the reference, the government law correlation stipulation, and makes the self-criticism by the actual case，Expectation contract of to the project condition center. Maybe seek the more appropriate suggestion way.
