工程變更設計衍生爭議調解案件之研究

Abstract

在營建工程的環境中，沒有一份工程規劃是完美的。然而主辦機關為了使工程圓滿完成，在履約過程中，辦理工程變更設計，此變更 設計改變了原工作範圍，營建承商透過合約條款規定請求補償，假若 任何一方無法同意其結果，便產生履約爭議事件。本研究之重點在於 探討主辦機關辦理工程變更設計之原因及營造承商因工程變更設計而 提出履約爭議調解案之原因，做深入之探討。

針對蒐集之實際案例，研究解決減少工程變更設計及減少因工程 變更設計而產生之履約爭議，以期能達到主辦機關及營造承商雙贏局 面，並適時提供預警及改善方法。其變更設計部分係依據主辦機關變 更設計做說明，並分析其變更設計之原因；履約爭議案部分係依據營 造承商向公共工程委員會提出之履約爭議案件，並作相關履約爭議案 說明及分析。透過此分析研究提供工程人員在公共工程履約階段，任 何一件變更設計事件之發生，對工程合約所造成之影響，提供可能改 善及管理之方式。

In construction project environment, there is no project to be perfect. But the government to make the project finish in perfect .When the contract execution caused by change orders. This of reducing has transform the original working .The construction firm ask to compensate used stipulate of the contract.If either party is unable to agree this result, the dispute is result. The focal point of this research lies the government change orders reason and the construction firm why the dispute is result in change order to do a deep discussion. To the real case that is collected, research and solve the project of reducing change orders, expect to reach and sponsor the organ and build the win-win situation of bearing trader. The explanation are change order with the government. Analysis is why did change order. The dispute is the construction firm proposition to Public Construction Commission. And analysis why did dispute. Analysis and research offer project personnel during the course of honoring an agreement in public project , the emergence of any incident of change order, to the influence caused of the project contract, may offer improving and management way.
