摘要: | 隨著台灣地區的製造生產成本日漸上漲,企業界陸續轉往其他開發中國家發展,在眾多的海外國家可以選擇的情形之下,其中因中國大陸地區自1979年起開始施行經濟改革開放政策,再加上與台灣有著相同的語言文化背景的優勢,因而成為台灣企業界轉往海外發展的首選之地。
昔日台商眼中提供低廉土地成本、廉價勞工、優惠租稅的大陸地區,近年來也逐步調整當地的政策方式。在這些政策改變當中又以2008年1月1日開始實行的《勞動合同法》對台商業者在生產經營上產生了最大的震撼。
雖然《勞動合同法》不但保護勞動者的合法權益,更進一步以促進企業主與勞動者之間的關係和諧發展,並欲在此基礎上實現勞資雙贏為目標。但是從歷史的經驗與人性的觀點來看,我們很清楚的意識到,這樣的和諧境界並不是這麼一蹴可幾的!這種境界是必須經過時間的歷練與醺陶,才可能會漸漸的成為大眾所能接納的想法與概念。
本研究欲探究《勞動合同法》實施後,對於台商企業投資意願的影響。除了企業本身的投資年限、雇用員工人數、所投入的資本額等企業基本特性之外,並加上企業於大陸地區經營的穩定度、投資的自主性、企業於大陸地區管理合法程度以及《勞動合同法》實施前後管理的差異程度等方向,以實證研究方式探討其關係。 Due to the increase of Taiwan area's manufacture production costs, enterprises try to transfer their business to other overseas countries. Although there are numerous overseas locations can be chosen, the mainland China is always the first priority choice, not just because of the economic reform policy since 1979, but also the same language cultural context superiority with Taiwan. Although the mainland China used to provide the inexpensive land and labor, the preferential benefit land and other taxes, it recently gradually adjusted the local policies. The most important one is the “Law of the People’s Republic of China on Employment Contract”. The law is based on protecting worker's legitimate rights and interests, and further trying to improve the relationship between the employer and employees. We know that it is not an easy goal to reach. It should take a long time to be a consensus. This study is trying to investigate how the “Law of the People’s Republic of China on Employment contracts” impacts the Taiwan enterprises’ investment willing. |
