摘要: 與日遽增的網路使用者和電子商務交易的大量出現,已然增加了網路犯罪和侵權的機會,線上拍賣詐欺案件的層出不窮便是其中一項惡果,如何提供消費者在從事線上拍賣交易時一個安全的電子商務環境便是本研究所欲探討的主題。本論文以個案研究的方法,針對國內外所發生的詐欺案例進行介紹,藉由研究分析的結果,整理歸納出消費者、拍賣網站以及政府在面對線上拍賣詐欺時可能採取的策略為何。 研究結果顯示,不管是被動的依賴拍賣網站所提供的防堵詐欺措施,抑或是主動的依據司法程序進行求償,消費者在面對線上拍賣詐欺時均處於相對弱勢的地位,單方面透過消費者自身的謹慎小心,並無法減少網路拍賣詐欺的現象,唯有藉由政府、拍賣網站以及消費者三方的共同努力,才有降低消費者在網路上遭受拍賣詐欺的可能性,進而亦能掃除阻礙電子商務交易蓬勃發展的絆腳石。 根據上述發現,本研究針對國內應該如何防堵線上拍賣詐欺提出建議,亦即推動拍賣網站應負詐欺部份責任之立法,以及儘速建立能夠提供消費者於線上交易發生爭議時之解決機制,最後再針對拍賣網站若面對前項政府立法時,又應該如何管理立法風險提出建言。
The increasing numbers of the Internet users and E-commerce transactions have increased cyber crime and tort cases. Online auction fraud case is one kind of them. How to provide a safe E-commerce environment for online auction users is the main subject of this study. This study adopted the method that similar to case study to introduce foreign and domestic fraud cases. By the results of this study, we conclude that the possible strategies of the consumers, online auction sites and government could adopt when they confront online auction fraud. The results show that whether consumers passively rely on the measures of online auction sites, or actively base on the judicial proceedings to refund, they are all in a relatively disadvantaged position. It cannot reduce online auction fraud only through the carefulness of the consumers themselves. Instead, government, online auction sites and consumers should all cooperate to reduce online auction fraud and could also eliminate the stumbling block of the developing E-commerce transactions. Based on the above findings, this study recommends how to prevent online auction fraud from deteriorating domestically, that is, to enforce online auction sites to take financial responsibility for fraud and to establish alternative dispute resolution mechanism for consumers as soon as possible. At last, we make suggestions that how to manage the risk of online auction sites when they face the following legislation.
